Meeting Minutes

Objective

 

1)

 

Welcome and Opening Remarks:  Meeting opened at 1:30pm with meeting protocols regarding muting of phones and personal identification when speaking.

 

2)

Roll Call – Roll Call was taken with a quorum present.

3)

Review and Approval of Meeting Agenda – The Agenda was approved unanimously by the committee members. 

4)

Approval of Minutes of March 2, 2016 – Motion was entered by David Compton and seconded by Dan Lavrich to accept the minutes as posted.  Unanimous approval.

To consider and discuss the following declaratory statement:

DS 2015-150 by Rolando Soto, Chief Code Compliance Officer, Mechanical, of Broward County Board of Rules and Appeals.

 

  • The petitioner, Rolando Soto, was present.  A reintroduction of declaratory statement was given, including modifications to the original petition.  Mo Madani gave the staff analysis for the declaratory statement with revisions for changes to the petition.

 

  • Afterward  there was general discussion by the Structural TAC and the Mechanical TAC.  Questions were asked by Daniel Lavrich, David Compton, Daniel Lavrich, Oscar Calleja, Jaime Gascon, Warner Chang, Cris Fardelmann, Pete Quintela, Joe Crumb. There were also questions and statements from the petitioner.

 

  • Per Mo Madani, there are substantial changes to the code to be made, per House Bill 535.  HB 535 Will also affect Florida Statute 553.844 and related sections of the current Florida Building Code.  Due to this, Mo Madani recommended that the petitioner defer this declaratory statement request until after the bill goes into effect, July 1st, 2016.  There was some discussion from the TAC members concerning the language of the F.S. 553.844.  Mo stated that there will be a glitch cycle to the 5th Edition (2014) Florida Building Code to process code changes as mandated by HB 535.

 

  • Due to the time passed since initial submittal of the petition one of the projects under consideration for the declaratory statement had been completed.  April Hammonds, legal counsel, stated that the TAC would be able to “Motion to grant in part and deny in part” if the TAC wished to make a motion other than deferral.  Question B of Staff Analysis would not be valid to answer.  The Petitioner, Rolando Soto, stated that he would agree to a deferral of this declaratory statement until after the new bill goes into effect after July 1, 2016.

 

Committee Action:

 

  • There was a motion by David Compton to defer the declaratory statement until the next available meeting which would be held after July 1, 2016 and it was seconded by Craig Parrino. The motion passed unanimously.
